1. Acceptance The Use Of AlgoEye Pty Ltd Terms and Conditions¶
Please read these Terms of Service (‘Agreement’, ‘Terms of Service’) carefully before using algoeye.com (‘the Site’) operated by AlgoEye Pty Ltd (‘us’, ‘we’, or ‘our’). This Agreement sets forth the legally binding terms and conditions for your use of the Site at algoeye.com.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. By using the Site you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Site.
2. Credit card details¶
AlgoEye Pty Ltd will never ask for Credit Card details and request that you do not enter it on any of the forms on the Site.
The contents of the Site do not constitute advice and should not be relied upon in making or refraining from making, any decision.
4. Change of Use¶
AlgoEye Pty Ltd reserves the right to:
4.1 change or remove (temporarily or permanently) the Site or any part of it without notice and you confirm that AlgoEye Pty Ltd shall not be liable to you for any such change or removal and.
4.2 change these Terms and Conditions at any time, and your continued use of the Site following any changes shall be deemed to be your acceptance of such change.
6.1 All copyright, trade marks and all other intellectual property rights in the Site and its content (including without limitation the Site design, text, graphics and all software and source codes connected with the Site) are owned by or licensed to AlgoEye Pty Ltd or otherwise used by AlgoEye Pty Ltd as permitted by law.
6.2 In accessing the Site you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Site for personal, non-commercial home use only.
7. Disclaimers and Limitation of Liability¶
7.1 The Site is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
7.2 To the extent permitted by law, AlgoEye Pty Ltd will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Site.
7.3 AlgoEye Pty Ltd makes no warranty that the functionality of the Site will be uninterrupted or error free, that defects will be corrected or that the Site or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
7.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of AlgoEye Pty Ltd for death or personal injury as a result of the negligence of AlgoEye Pty Ltd or that of its employees or agents.
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You agree to indemnify and hold AlgoEye Pty Ltd and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against AlgoEye Pty Ltd arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Site.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
11. Governing Law¶
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of NSW, Australia, without giving effect to any principles of conflicts of law.
12. Changes To This Agreement¶
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.

Personal identification information¶
We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, subscribe to the newsletter, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.
Non-personal identification information¶
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.
How we use collected information¶
AlgoEye Pty Ltd may collect and use Users personal information for the following purposes:

- Information you provide helps us respond to your customer service requests and support needs more efficiently.
- To personalize user experience
- We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.
- To improve our Site

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

Compliance with children’s online privacy protection act¶
Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Site from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.
Your acceptance of these terms¶
By using this Site, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
